UCITS funds


A UCITS fund is a collective investment scheme, so-called “retail", that is aimed at small investors, and is regulated by the relevant European legislation (Directive 2014/91 / EU), which regulates marketing and sets limits on investment, instruments and exposure, to protect investors.


This instrument’s great potential lies mainly in the marketing possibilities for all categories of investors, including retail investors, and all over Europe thanks to "passporting " (that is, notifying the supervisory authority of the country in which it is distributed, without the need for further authorization)


A UCITS fund can be launched in Malta as a Sicav, or in other forms foreseen by Maltese legislation:


  • Limited Partnership
  • Unit Trust
  • Contractual Fund

In Spite of the possibilities highlighted above, a Ucits Fund must meet some additional requirement, including:


  • A minimum capital of €300,000;
  • At least one director resident in Malta;
  • Establish a Risk Management function independent from the operational management which is able to adequately manage conflicts of interest;
  • Have an authorized Ucits Manager, or in case of self-managed fund, an Investments Committee within the Board of Directors, composed of qualified members and individuals deemed suitable by the regulator;

The Investment Management role of Ucits funds is reserved by law to companies authorized as " Ucits Management Company" by ' Maltese authorities (MFSA), or by another Community regulator.
